The Court of Appeal struck out an application filed by the Senate President, Bukola Saraki, to stop his trial.
Mr. Saraki approached the court to compel the tribunal to stay action on an arrest order issued against him on Friday.
Despite the appeal, the tribunal resumed trial on Monday without Mr. Saraki’s appearance.
Although, his team of lawyers argued against the composition of the tribunal, its chairman, Justice Danladi Umar, ruled that the senate president must appear before it on Tuesday, the day it adjourned to.
The senate president has agreed to appear before the tribunal.
